Terms of service

Terms and Conditions

1. Scope

These Terms and Conditions apply to orders placed through the online shop operated by:

InnerPie GmbH
Wilen 7
6313 Finstersee
Switzerland
Email: info@innerpie.ch

Hereinafter referred to as “InnerPie”.

By submitting an order, the customer agrees to these Terms and Conditions.

2. Products

InnerPie offers freshly prepared, made-to-order baked goods, desserts and other food products.

Product images in the online shop are for presentation purposes. As our products are handmade and natural ingredients are used, the appearance, colour, shape and decoration may vary slightly from the images shown.

The product description displayed in the online shop at the time of ordering applies.

3. Orders and Conclusion of Contract

Customers can select products, add them to the shopping cart and review and correct their information before submitting the order.

By submitting an order, the customer places a binding order.

The automatic order confirmation sent immediately after submission only confirms that InnerPie has received the order. It does not yet constitute acceptance of the order by InnerPie.

InnerPie reviews each order, including product availability, production capacity, the requested delivery or pickup date and, where applicable, the delivery area.

The contract is concluded when InnerPie confirms the order and sends the customer the corresponding payment request or invoice.

InnerPie reserves the right to decline an order, particularly where the requested products, date, time or delivery to the specified address cannot be accommodated.

4. Prices

All prices displayed in the online shop are stated in Swiss francs (CHF).

Any applicable delivery charges are displayed during checkout according to the selected delivery method and delivery address.

The total amount of the order confirmed by InnerPie is the applicable amount.

5. Payment

Orders are initially submitted to InnerPie without payment and are reviewed by us.

Once the order has been confirmed, the customer receives an invoice or payment request by email containing the available payment options.

Depending on the order, the following payment methods may in particular be offered:

TWINT
Payment may be made using TWINT. When payment is made through a payment link, the customer is directed to the corresponding secure payment process.

Credit and debit cards
Supported credit and debit cards may be processed through our payment service provider Stripe. Payment information is processed by the payment service provider as part of the payment transaction.

QR invoice / bank transfer
Where offered, payment may be made using the payment details stated on the invoice.

The payment methods actually available will be shown in the payment request or payment process.

Payment must be made within the deadline stated on the invoice or payment request.

InnerPie may make production, delivery or handover of an order conditional upon timely payment.

TWINT's current merchant terms expressly provide for distance transactions initiated by email or similar means using a payment link or QR code.

6. Delivery

InnerPie provides local delivery within the delivery areas specified in the online shop.

Delivery availability and delivery charges depend on the delivery address or postal code and the order value and are displayed during checkout.

Customers can select an available delivery date and time slot during the ordering process.

Delivery times are planned time windows. Minor deviations may occur, particularly due to traffic, weather or other circumstances outside our reasonable control.

The customer is responsible for providing a complete and correct delivery address and the necessary contact details and for ensuring that the order can be received at the agreed time.

7. Store Pickup

Where available, orders may be collected from InnerPie free of charge.

Pickup address:
InnerPie GmbH
Wilen 7
6313 Finstersee
Switzerland

An available pickup date and time slot can be selected during checkout.

Orders should be collected within the confirmed time slot.

8. Changes and Cancellations

As our products are freshly and individually prepared to order, InnerPie does not generally offer a voluntary right of withdrawal or return.

Changes to or cancellations of confirmed orders are possible only by prior agreement with InnerPie.

Whether an order can still be changed or cancelled depends in particular on whether ingredients or products specifically required for the order have already been purchased or production has already begun.

Statutory rights relating to defective or incorrectly supplied products remain unaffected.

Swiss law does not provide a general statutory right of withdrawal for ordinary online purchases, although sellers may offer one voluntarily.

9. Inspection and Complaints

Customers are requested to inspect their order upon delivery or collection.

Any obvious defect, damage or incorrect delivery should be reported to InnerPie as soon as reasonably possible after receipt.

Complaints may be submitted by email to info@innerpie.ch. InnerPie may request photographs and additional information about the affected product in order to assess the complaint.

Any mandatory statutory warranty rights remain unaffected.

10. Allergens and Intolerances

Information concerning ingredients and allergens is provided to the best of our knowledge.

Customers with allergies or intolerances are responsible for informing InnerPie of relevant requirements before the order is concluded and for contacting us before ordering if anything is unclear.

Unless expressly confirmed otherwise, InnerPie cannot guarantee that products are completely free from traces of particular allergens.

11. Storage and Handling

Our products are freshly prepared and some are perishable.

Following delivery or collection, the customer is responsible for appropriate storage and handling of the products. Any instructions regarding refrigeration, storage and consumption must be followed.

12. Liability

InnerPie is liable in accordance with applicable mandatory law.

To the extent permitted by law, InnerPie is not liable for damage resulting from improper storage or handling after the product has been handed over, incorrect or incomplete information provided by the customer, or circumstances outside InnerPie’s reasonable control.

Mandatory statutory liability provisions remain unaffected.

13. Data Protection

Personal data is processed in accordance with our Privacy Policy and applicable data protection law.

Where external payment service providers are used, information required for processing the payment may be processed by the relevant payment service provider.

14. Applicable Law and Jurisdiction

Swiss law applies.

Any dispute is subject to the mandatory statutory rules on jurisdiction. In particular, mandatory jurisdiction provisions protecting consumers remain unaffected.
